Update: Removal of children from YFZ Ranch not legally correct

Today a Texas appeals court ruled that the state had not proven that the children on the Yearning for Zion Ranch outside of Eldorado were in “imminent danger” before they were removed. This CNN.com article has the story. Curiously, the ruling did not mean that the children would be returned to their parents.
Instead, the judges gave the lower court 10 days to vacate an order placing the children in state custody.
This removal of more than 450 children was initially seen as a victory for the protection of children. The practice of polygamy and underage marriage by the Fundamentalist Church of Jesus Christ of Latter-day Saints are well known, yet few state efforts have attempted to enforce laws prohibiting them. Now it’s not clear if the state of Texas took the proper steps to help these children.
